Terms and Conditions of Cytrynka Online Store - Rules and Policies

1. GENERAL PROVISIONS

  1. The online store cytynka.com.pl, operating at: www.cytynka.com.pl, is operated by ANDRII ZEMTSOV, with its registered office at: 43-190 Mikołów, ul. Podleska 50L, entered into the Central Registration and Information on Business of the Republic of Poland with NIP number: 6351871462, REGON: 529003144.
  2. These Online Store Regulations define the rules for making purchases in the online store cytynka.com.pl, in particular the terms and procedures for concluding distance sales contracts via the Store, complaint procedures, and the Consumer’s right to withdraw from the contract.
  3. In the scope of services provided electronically, these Regulations are the regulations referred to in Article 9 of the Act on the Provision of Electronic Services dated July 18, 2002 (i.e., Journal of Laws of 2020, item 344, as amended).
  4. The Regulations are addressed to all Customers of the Store. All Customers are obliged to familiarize themselves with its provisions before making a purchase.
  5. Each Customer agrees to comply with the provisions of the Regulations. Sales are conducted based on the version of the Regulations valid at the time of placing the order.
  6. The Customer can read the Regulations at any time by clicking on the “Store Regulations” link on the cytynka.com.pl website. The Regulations can also be downloaded and printed.
  7. All information contained on the cytynka.com.pl website regarding products (including prices) does not constitute an offer within the meaning of Article 66 of the Civil Code dated April 23, 1964 (i.e., Journal of Laws of 2020, item 1740, as amended), but an invitation to conclude a contract within the meaning of Article 71 of the same Code. By sending the Order Form, the Customer submits an offer to purchase the selected Goods at the price and under the conditions specified in its description.

2. DEFINITIONS

Regulations – this set of rules defining the terms of use of the Store’s Services by Clients.

Consumer – the term “Consumer” refers to the following persons:

  • A natural person entering into a civil law contract via the Store, not directly related to their business or professional activity – known as a “Consumer in the strict sense”;
  • A natural person entering into a civil law contract via the Store, directly related to their business activity, when the content of this contract indicates that it does not have a professional character for this person, particularly resulting from the subject of their business activity, made available based on the provisions on the Central Registration and Information on Business – known as an “Entrepreneur with Consumer Rights”.

For the purposes of these Regulations, it is assumed that in the absence of distinction between these two groups of entities, the Regulations apply both to Consumers in the strict sense and Entrepreneurs with Consumer Rights.

Client – a natural person (including Consumer) who is at least 13 years old (provided they have obtained consent from a legal representative), a legal person, or an organizational unit without legal personality, to which specific provisions grant legal capacity, who uses the Services provided by the Store.

Order Form – a service available on the Store’s website, through which the Client can make a purchase, in particular by adding Goods to the Cart and specifying certain terms of the Sales Agreement, such as the method of delivery and payment.

Cart – a component of the Store where the Goods selected by the Client are visible, and where the Client has the ability to determine and modify the Order data, including the quantity of Products purchased.

Store – the online service owned by the Seller, available at the domain: www.cytynka.com.pl, through which the Client can purchase Goods from the Seller.

Seller – ANDRII ZEMTSOV, with its registered office at: 43-190 Mikołów, ul. Podleska 50L, NIP: 6351871462, REGON: 529003144., who, conducting profit-making or professional activity, offers sales through their website.

Goods – a movable item being the subject of transactions between the Store and the Client, the terms of sale of which are defined by the Order Form.

Sales Agreement – a distance sales contract for Goods concluded between the Client and the Seller via the Store, usually through the Order Form.

3. ORDER PLACEMENT AND FULFILLMENT

To use the Store, you must read and accept the terms of this Regulation. By placing an order, the Customer confirms their agreement with the provisions of the Regulation.

Orders from Customers are accepted 24/7, seven days a week, by completing and submitting the Order Form on the website cytynka.com.pl.

To place an order, the Customer adds selected products to the cart by clicking the “ADD TO CART” button next to the product description. Then, in the “CART” section, they complete the Order Form, selecting the delivery and payment method or choosing the cash-on-delivery option if available for the selected product, and confirm the order. The Client is obliged to register on the website. The registration process is an integral part of placing an order, therefore the creation of the Account takes place directly during the purchase procedure. If the Client already has an Account on the website, they can log in using the previously established login and password.

Entrepreneurs considered “Entrepreneurs with consumer rights” (see the definition of “Consumer” in this Regulation), when placing orders after January 1, 2021, must indicate that the purchase is not of a professional nature for them.

After placing an order, the Customer receives a confirmation email sent to the address provided in the Order Form.

Once the order is confirmed, the Seller begins processing it:

  • For orders with cash-on-delivery payment – processing begins no later than the next business day after order confirmation.
  • For orders with advance payment via bank transfer – processing begins after the funds are credited to the Store’s account.

Orders are processed during the Store’s working hours (Monday to Friday, from 9:00 AM to 4:00 PM). Orders placed after 4:00 PM or on weekends and public holidays are processed on the next business day.

Notification of order acceptance for processing signifies the conclusion of the Sales Agreement between the Customer and the Seller upon its receipt by the Customer.

A fiscal receipt is attached to each order.

The price stated in the order is the total amount the Customer is required to pay, including all taxes and delivery costs.

The Seller reserves the right to change prices, add new products, conduct or cancel promotional offers, and make modifications to them in accordance with applicable law.

If the Consumer is required to pay an amount exceeding the agreed price, the Store will immediately notify the Consumer, explaining the reason for the discrepancy. Additional charges will only be applied after receiving explicit consent from the Consumer.

The Seller guarantees that the delivered products are free from defects.

4. AVAILABLE PAYMENT METHODS

At the cytrynka.com.pl online store, you can pay for your order by bank transfer or payment card. We accept the following card types:

  • Visa
  • Visa Electron
  • Mastercard
  • Mastercard Electronic
  • Maestro

Online Payment Processing

The entity providing online payment processing services in our store is Autopay S.A.. All transactions take place in a secure, encrypted environment, ensuring the protection of customer data.

5. DELIVERY

Delivery of Products from the Cytrynka.com.pl Online Store: InPost Lockers and Courier Service

At Cytrynka.com.pl, we provide fast and convenient shipping of orders throughout Poland thanks to our partnership with InPost. This logistics provider offers two delivery methods: via InPost Lockers or InPost Courier.

InPost Lockers

InPost Lockers are modern, self-service deposit boxes available all over Poland, accessible 24/7. This means you can pick up your package whenever it suits you best.

Ideal choice for small to medium-sized parcels.

Benefits of InPost Lockers:

  • Collect your order at any time convenient for you.
  • Short delivery time — usually 1–2 business days from dispatch.
  • Affordable shipping rates.

InPost Courier Delivery

InPost Courier is an excellent solution if you’re ordering larger products or simply prefer having your package delivered right to your door.

For oversized goods (e.g., large dog beds), only courier delivery is available, as they do not fit into the lockers.

Advantages of courier delivery:

  • Convenience — the courier brings the parcel directly to the specified address.
  • Speed — delivery typically takes 1–2 business days after dispatch.
  • Order Dispatch Times

At Cytrynka.com.pl, we strive to process your order as quickly as possible. All parcels are dispatched within 2 business days of payment confirmation.

Delivery time after shipment:

  • InPost Lockers — delivery generally takes 1–2 business days.
  • InPost Courier — also arrives in about 1–2 business days.

Restrictions for Large Items

If you’re ordering larger items, such as big dog beds, they cannot be shipped to InPost Lockers due to size limitations. In that case, only courier delivery is available.

How to Choose a Delivery Method?

During checkout, our system automatically determines which delivery methods are available for your particular item.

If the package dimensions meet the locker requirements, you’ll be able to select InPost Lockers.

For large shipments, only courier delivery will be offered.

6. THE RIGHT TO WITHDRAW FROM THE CONTRACT

  • Time limit for withdrawal from the agreement

Pursuant to the applicable law, in particular the Act of 30 May 2014 on Consumer Rights, the Consumer has the right to withdraw from a remotely (online) concluded agreement within 14 days. This period is counted from the date the Consumer or a third party (other than the carrier) takes possession of the goods.

  • Form for filing a withdrawal request

To exercise the right of withdrawal, the Consumer must submit a clear and unambiguous declaration of withdrawal in writing or electronically (e.g., via a provided link or email).

  • Consequences of withdrawal from the Agreement

In the event of a valid and timely withdrawal, the contract shall be deemed not to have been concluded, and the Consumer shall be released from all obligations arising therefrom.

The Seller undertakes to refund all payments received from the Consumer (including, where applicable, the standard delivery cost) no later than 14 days from the date the notice of withdrawal is received.

Refunds will be made using the same payment method the Consumer originally used, unless the Consumer explicitly agrees to a different method that does not entail any additional costs.

Obligations of the Consumer

  • The Consumer is obliged to return the goods without undue delay, but no later than 14 days from the day they notified the Seller of their intention to withdraw from the contract.
  • The Consumer shall bear the direct costs associated with returning the goods, unless otherwise stipulated by the Seller.
  • The Consumer is liable only for any diminished value of the goods resulting from the handling of them beyond what is necessary to establish their nature, characteristics, and functioning.

Exceptions to the right of withdrawal

In certain cases specified in the Act of 30 May 2014 on Consumer Rights, the right of withdrawal does not apply. In particular, this concerns:

  1. Goods delivered in sealed packaging that, once opened, cannot be returned for health or hygiene reasons if the seal has been broken.
  2. The provision of services or digital content that began, with the Consumer’s prior express consent, before the end of the 14-day withdrawal period, and the Consumer was informed of losing the right to withdraw under those circumstances.
  3. Other cases specified in Article 38 of the aforementioned Act or other applicable legal provisions.

All actions undertaken by the Seller with regard to withdrawals from the contract and goods returns are carried out in strict compliance with the applicable Polish law, in particular the Act on Consumer Rights and the relevant provisions of the Civil Code. Any disputes or matters not provided for in this clause shall be governed by the legislation of the Republic of Poland.

7. PERSONAL DATA PROTECTION

By placing an order, the Customer consents to the processing of their personal data provided for the purpose of order fulfillment and servicing by the Seller, who is also the data controller, in accordance with Article 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The Seller is the data controller of the personal data provided by the Customer while using the Store.

Personal data stored in the Seller’s database is not shared with third parties who are not involved in the execution of the Sales Agreement.

In accordance with Article 15 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the Customer has the right to access their personal data, request its correction, or request its deletion. The Seller ensures that every Customer has the right to control the processing of their personal data.

Providing personal data is voluntary; however, the lack of consent to its processing makes it impossible to complete the Customer’s order.

8. OUT-OF-COURT DISPUTE RESOLUTION

If the Consumer is dissatisfied with the outcome of their complaint, they have the option to use several alternative methods for resolving disputes:

  • Mediation. Mediation is conducted by the territorially competent Voivodeship Trade Inspection Office. To initiate the process, a mediation request must be submitted. This procedure is generally free of charge. A complete list of inspection offices is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
  • Consumer Arbitration Court. Permanent consumer arbitration courts operate at the Voivodeship Trade Inspection Offices. To have a case reviewed, a request must be submitted. Participation in this procedure is generally free of charge. A list of available arbitration courts can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
  • Consultation with a Consumer Ombudsman. This can be a municipal or district consumer ombudsman who provides free assistance in protecting consumer rights.
  • ODR Platform. This is an online dispute resolution platform available at: http://ec.europa.eu/consumers/odr/.

The above section on alternative dispute resolution does not apply to entrepreneurs acting with consumer rights (so-called “Entrepreneurs with Consumer Rights”) if the contract was concluded after January 1, 2021. All other Consumers are entitled to use these methods for resolving disputes.

Thus, these options are available only to individual consumers who are not engaged in professional activities related to the subject of the contract.
